The Parents′ Obligation for Family Education and Its Legislative Regulation

Abstract
The parents′ family education for their children is fundamental, lifelong, prior and selective. The parents′ rights for family education have experienced historical evolution from ″patriarchal rights″ and ″parental rights″ to ″parental obligations″. The obligations are mainly manifested in three aspects: educating children in daily life, sending children to school for compulsory education and participating in children′s school education. Clarifying the obligations of parents in family education is the core issue in our country′s family education legislation. It is necessary to legislate and regulate the functions of parental education, punishments for parents′ failure to perform compulsory education duties and parents′ participation in children′s school education so as to realize the balance between family education rights and obligations.
